PLEASE READ THIS LICENCE AGREEMENT CAREFULLY BEFORE CONTINUING. IF YOU DO NOT
ACCEPT THE TERMS OF THIS LICENCE, YOU MUST NOT INSTALL OR USE THE IMAGE.
This End User Licence Agreement ("EULA") is a legal agreement between you (the
Licensee) and Maia EDA Ltd., a company registered in England and Wales under
number 12872660 (the Licensor).
This EULA covers the Server123 installation image (the 'Image'), and the use
of the Image. This EULA grants a licence to use the Image. The Licensor does
not sell or assign the Image or any associated documentation to you.
After installation, this EULA is available from
https://example.com/data/licence.html, where 'example.com' is your own domain
name, as provided during Image installation.
-
Definitions and Interpretation
In this EULA, unless the context otherwise requires, the following
expressions have the following meanings:
"Image" means the Server123 installation image. The Image is a custom
installation of the Ubuntu Operating System, and is not
a derived work of, or a modified version of, the Ubuntu
Operating system. The Image is only available as a download
from server123.io/downloads;
"you", "your" means the Licensee.
-
System Requirements
You are responsible for installing the image on your own server, or a server
provided by a third party. The System Requirements for an Ubuntu Server
installation can be found on the
Ubuntu website.
However, it should be noted that the Image requires at least 20GB of main
storage, and the additional software provided in the Image may not function
well with less than 4GB of RAM.
-
Accepting or Rejecting this EULA
-
By selecting "Y" below and clicking "Submit", you indicate your
acceptance of this EULA and the terms and conditions set out herein, which
will become binding on you upon your acceptance.
-
By selecting "N" below and clicking "Submit", you indicate your

-
Additional Software
-
The Image contains a number of additional programs which are not, by default,
installed with Ubuntu Server. These include Java, Ruby, Keycloak, Alfresco
Community Edition, Redmine, Roundcube, WordPress, phpMyAdmin, DokuWiki, and
mediaWiki. These programs are all supplied with some version of a free
licence. The Licensor has not entered into any licence agreements with the
suppliers of these programs, and it is the responsibility of the Licensee to
ensure that they are using these programs within the terms of their respective
licence agreements.
-
The additional programs are pre-configured to operate in a default manner
which should be sufficient for the needs of most users. Any additional
customisation must be carried out by the Licensee, to suit their own
individual requirements.
-
Server modifications
-
The Licensor makes no claims on the Operating System or any other programs
which are created as a result of installing the Image. The Licensee may modify
the Operating System, or any components thereof, in any way that they see fit.
-
Warranty
-
The warranty terms for the Ubuntu Operating System are available on the
Canonical website.
These state that Ubuntu is provided without warranty, and that "All implied
warranties are disclaimed to the fullest extent permitted at law."
-
The Image is provided "as is", without warranty of any kind, express or
implied, including but not limited to the warranties of merchantability,
fitness for a particular purpose and non-infringement. In no event shall the
Licensor be liable for any claim, damages or other liability, whether in an
action of contract, tort or otherwise, arising from, out of or in connection
with the Image or the use of or other dealings in the Image.
-
Law and Jurisdiction

therefrom or associated therewith) shall be governed by, and construed in
accordance with, English law.
-
Any dispute, controversy, proceedings or claim between the Parties relating to
this EULA (including any non-contractual matters and obligations arising
therefrom or associated therewith) shall fall within the jurisdiction of the

residency.
